WHAT TO DO IF YOUR CANADIAN IMMIGRATION APPLICATION IS REFUSED
If your Canadian immigration application is refused, you have a few options available to you. You can:
— Appeal the decision
— Renew your application
— Apply for a different visa class
APPEALING A DECISION
If you are unhappy with the decision made on your immigration application, you may be able to appeal the decision. The first step is to file a Notice of Appeal with the Immigration Appeal Division within 30 days of receiving the decision. Once you have filed your Notice of Appeal, you will be given a date for your hearing. At the hearing, you will be able to present your case to an Immigration Appeal Division panel. The panel will then make a decision on your appeal.
RENEWING YOUR APPLICATION
If your application was refused because it was incomplete or contained errors, you may be able to renew your application. To do this, simply submit a new application with the corrected information.
APPLYING FOR A DIFFERENT VISA CLASS
If you are not eligible for the visa class that you applied for, you may be able to apply for a different visa class. For example, if you applied for a work permit but were refused because you did not have enough experience, you may be able to apply for a study permit.
TIPS FOR PREPARING FOR AN APPEAL
If you decide to appeal the decision on your immigration application, there are a few things you can do to improve your chances of success:
— Make sure your application is complete and accurate
— Gather all of the evidence in support of your case
— Speak with a qualified lawyer or immigration consultant
